Terms and Conditions and End User License Agreement
1. Acceptance of Terms
By registering on or using the Platform, Users acknowledge and agree to be bound by this Agreement, our Privacy Policy, and any other applicable policies. If Users do not agree, they must refrain from using the Platform.
2. Eligibility
Users must be at least 18 years old or legally authorized to enter into agreements under Indian law. Organizations using the Platform must be legally registered entities in India.
3. User Responsibilities
- Provide accurate and up-to-date registration details.
- Maintain the confidentiality of their account credentials.
- Use the Platform for lawful purposes only.
- Abide by all applicable laws and regulations while using the Platform.
- Refrain from engaging in fraudulent, abusive, or misleading transactions.
4. Transactions & Payments
- The Platform facilitates transactions between buyers and sellers; however, Farmer Harvest is not liable for the quality, delivery, or fulfillment of products.
- Prepaid payments are securely held by Farmer Harvest until successful delivery of commodities.
- Payment transfers to sellers occur within three (3) business days of confirmed delivery, subject to statutory clearances.
5. Prohibited Activities
- Users shall not use the Platform for illegal, deceptive, or unethical practices.
- Engage in unauthorized access, hacking, or data breaches.
- Distribute malware, spam, or any form of harmful content.
- Impersonate another person or entity.
6. Data Protection & Privacy
- User data is processed in compliance with The Digital Personal Data Protection Act, 2023.
- Data is stored on India-based servers to ensure security and regulatory compliance.
- Users consent to data collection and processing as outlined in the Privacy Policy.
7. Termination & Suspension
Farmer Harvest reserves the right to suspend or terminate a User’s access to the Platform for:
- Violation of this Agreement or other policies.
- Engaging in fraudulent activities.
- Misuse of Platform services.
8. Limitation of Liability
Farmer Harvest shall not be liable for:
- Any losses arising from transactions between buyers and sellers.
- Any unauthorized access or security breaches beyond its reasonable control.
- Any indirect, incidental, or consequential damages arising from Platform use.
9. Amendments
Farmer Harvest reserves the right to modify this Agreement at any time. Users are advised to review the terms periodically.
10. Governing Law & Dispute Resolution
This Agreement is governed by the laws of India. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Bhubaneswar, Odisha.
